I. General provisions

1. These regulations define the rules for using the online store operated at www.olygems.com (Website) and its operation.

2. Glossary

Online Store – an online store operated at www.olygems@gmail.com by OLYGEMS, which enables the customer to place orders for goods.

Customer: a natural person - a consumer within the meaning of the provision of art. 22 1 of the Civil Code of the Republic of Poland, i.e. a natural person with full legal capacity, and an organizational unit that is not a legal person, to which special regulations grant legal capacity, which uses the store located at: www.olygems.com

Order: a declaration of intent of the customer placed via the online store located at www.flywayfinds.com, aiming directly at concluding a distance selling agreement.

Consumer: a consumer in accordance with the wording of Article 22 1 of the Civil Code of the Republic of Poland, a natural person concluding a legal act with an entrepreneur.

Seller: OLYGEMS

Commodity: an item that can be ordered via the online store.

Warehouse: place where an order placed by a customer is completed.

Working days : all days of the week from Monday to Friday, excluding public holidays, and Saturdays and Sundays.

Order processing time : the time in which the order placed by the customer should be completed and delivered to the address indicated by the customer in the order. This time does not include the time of non-working days and Saturdays and Sundays, as well as the time in which the Store waits for the customer to make the payment.

Shopping cart: an element of an online store through which the customer specifies their order by providing, among others, the shipping address, delivery method, payment method, and other data necessary to place the order.

II. Terms of Use of the Online Store

1. In the online store, the persons authorized to place orders for goods are customers.

2. The information provided on the website of the online store does not constitute an offer within the meaning of the provisions of the Civil Code of the Republic of Poland, but constitutes an invitation to submit offers by the store's customers. The conclusion of the agreement requires, first of all, the submission of an appropriate order by the customer, and then verification of the order by the Seller, in particular in terms of the availability of goods.

3. The Customer places an order, among other things, by adding goods to the basket and providing the necessary personal and address data enabling the execution of the order, then confirming the order for the Goods by selecting the button - "I order and pay". The initial verification of the order will be made by sending to the Customer via e-mail information about the order placed by the Customer.

4. Acceptance of the regulations is voluntary, but necessary in order for the customer to purchase goods in the online store.

5. Orders can be placed in the Online Store 24 hours a day. Order fulfillment takes up to 10 business days.

6. In justified cases, the Seller reserves the right to additionally verify the Customer's data.

III. Placing an order, concluding a sales contract

1. The sales agreement is concluded at the moment the seller confirms the acceptance of the customer's order for execution. Confirmation is made by sending the customer information via e-mail confirming the acceptance of the customer's order for execution.

2. The prices given in the Online Store are binding and cannot be negotiated. The cost of delivery of the Goods is added to the price of the Goods. The cost of delivery of the Goods is indicated in the Basket during the ordering process.

3. The customer has the right to choose the following payment methods:
a. payment by card
b. payment via PayPal
c. payment via Apple Pay*
d. BLIK payment

*On mobile phones only.

4. The condition for accepting an order for execution is making payment for the ordered Goods.

5. The Seller delivers the Goods to the Customer and the document confirming the conclusion of the contract for the sale of Goods, the invoice is sent to the e-mail address of the buyer.

6. The Customer's obligations arising from the contract for the sale of Goods shall remain in force until the entire amount due for the Goods and the Costs of delivering the Goods have been paid.

IV. Delivery of goods

1. The order fulfillment time for Goods ordered in the Online Store is no longer than 14 business days. The deadline for delivery of Goods runs from the day of sending the Customer confirmation of acceptance of the order for fulfillment. The Online Store may inform the Customer about the expected delivery date.

2. The Customer may choose the following delivery method:
Pick-up by the Customer at the address indicated in the order placed by the Customer

4. Delivery of the parcel containing the ordered Goods to the address indicated by the Customer will be made on a business day by courier. The Seller may use various courier companies.

5. The Seller undertakes to deliver the Goods free from defects.

V. Withdrawal from the contract

1. A Customer who is a consumer may return the Goods purchased in the Online Store without giving a reason by submitting to the Seller a declaration of withdrawal from the contract for the sale of Goods in accordance with art. 27 of the Act of 30 May 2014 on consumer rights. The Customer may exercise this right within 14 days of receiving the Goods.

2. In the event of withdrawal from the contract for the sale of Goods in the manner specified in this section, the Customer is obliged to return the Goods to the Seller within 14 days of receipt of the shipment.

3. In the event of withdrawal from the contract for the sale of Goods, the contract for the sale of Goods is deemed not to have been concluded.
4. The consumer does not have the right to withdraw from the contract in the cases specified in detail in art. 38 section 1 of the Act of 30 May 2014 on consumer rights, including in relation to contracts for the provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the commencement of the service that after the entrepreneur has performed the service, the consumer will lose the right to withdraw from the contract;
or where the subject of the provision is a non-prefabricated item, manufactured according to the consumer's specifications or intended to meet his individual needs.

5. If the Customer exercises the right to withdraw from the contract for the sale of Goods after submitting a request for the Seller to start providing the service before the deadline for withdrawal from the contract expires, the Customer will be obliged to pay for the services provided until the time of withdrawal from the contract.
6. The Seller will refund the Customer for the Goods returned by the Customer within 14 days from the date of delivery to the Seller of the declaration of withdrawal from the contract for the sale of Goods. The Seller may withhold the refund of payments received from the Customer until the returned Goods are received.

7. Withdrawal from the contract for the sale of Goods may be made by reporting to info.olygems@gmail.com

VI. Complaints

1. The Seller is liable to the Customer under the warranty for defects to the extent specified in the Civil Code. The Customer who is a consumer and purchases the Goods for purposes unrelated to business activity is entitled to rights arising from the provisions of the Act of 30 May 2014 on consumer rights.
2. Complaints about the Goods should be sent to the e-mail address: info.olygems@gmail.com within 5 days of receipt of the goods.

3. A complaint about the Goods will be considered within 14 days from the date of submission of the complaint. The Customer will be notified by e-mail or telephone about the method of considering the complaint about the goods.

4. The complaint should describe the non-conformity of the goods with the contract, and also indicate whether the Customer requests the removal of the defect or replacement with a defect-free item or a reduction in price or withdrawal from the contract. The Customer cannot withdraw from the contract if the defect is insignificant.

5. The Customer is not entitled to request a price reduction or withdrawal from the contract if the Seller immediately and without excessive inconvenience to the Customer replaces the defective item with a defect-free one or removes the defect.

VII. Personal data

1. The Customer's personal data registered in the Store are processed by the Seller as the controller of personal data on the basis of the Act of 29 August 1997 on the Protection of Personal Data (Journal of Laws of 2002, No. 101, item 926, as amended) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) of 27 April 2016 (OJ EU L No. 119, p. 1) ("Regulation") for purposes related to transactions made within the Store and for purposes resulting from legitimate interests pursued by the Seller, as well as based on the Customer's consent - for purposes consistent with the content of the consent granted, including commercial and marketing.

2. Providing data is voluntary, but necessary for the execution of the order. Failure to provide personal data prevents transactions within the Store. This does not apply to the processing of data for commercial and marketing purposes, which is only carried out in the case of voluntary consent, regardless of transactions within the Store.

3. The Customer has the right to request from the Seller access to personal data concerning him, the right to rectify, delete or limit processing. The Customer has the right to withdraw consent to the processing of personal data at any time without affecting the lawfulness of processing based on consent before its withdrawal.

4. Personal data will be stored for the period necessary to complete the transaction in the Store and to consider the complaint and are processed for a period of 3 years from the date of the transaction. In the case of processing personal data for legally justified purposes of the Seller and based on the Customer's consent - the data are stored until the consent is withdrawn.

5. The Client has the right to lodge a complaint with the President of the Personal Data Protection Office (and before 25 May 2018, with the Inspector General for Personal Data Protection) if he or she considers that the processing of his or her personal data violates the provisions of the law.

VIII. Newsletter

1. The Client may order the sending of information in the form of the Online Store Newsletter to the e-mail address provided by him/her. By placing an order for the sending of the Newsletter, the Client simultaneously ensures that he/she is authorized to dispose of the e-mail address to which the information is to be sent.
2. The Customer is entitled to unsubscribe from the Online Store Newsletter at any time.

X. Final Provisions

1. The online store reserves the right to change the regulations. The Seller will notify Customers of any change to the regulations by placing an appropriate message on the website www.flywayfiinds.com. Customers who have registered in the online store will be notified of the change to the regulations and the possibility of accepting them. Refusal to accept the regulations is equivalent to terminating the contract for the provision of services by electronic means.

2. Disputes between the Seller and the Customer who is a consumer shall be resolved by a common court having jurisdiction in accordance with the provisions of the Code of Civil Procedure, unless, in accordance with these regulations, disputes shall not be resolved out of court.

3. In the event of a change in the regulations, orders placed before the date of introduction of changes to the regulations will be fulfilled under the previous principles.

4. In matters not regulated in the Regulations, the provisions of the Act of 30 May 2014 on consumer rights shall apply. The provisions of these Regulations do not violate consumer rights due to the non-conformity of the goods with the contract.
5. All names of Goods offered for sale by the Online Store are used for identification purposes and may be protected and reserved under the provisions of the Act of 30 June 2000 - Industrial Property Law.



SERVICE AND PRICE MODIFICATIONS
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

PRODUCTS OR SERVICES (if applicable)
Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Returns Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colors will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
We do not warrant that the quality of any products, Services, information or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order placed with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we change or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.
